History, Definition, and Purpose:

The Diversion Program, established in 1976, is based on the exercise of Attorney General discretion; it does not have a statutory basis. The program provides an alternative to felony prosecution for first-time nonviolent offenders. It enables an offender to be responsible and accountable, and to receive counseling while avoiding the stigma of a felony record.

Program Description:

On entry into the program the offender signs a written contract which specifically states the requirements of his/her program. The program runs between six months and one year and may involve counseling, community service and restitution. If the offender completes the program, the State dismisses the charge.
