AN ACT RELATING TO DOMESTIC VIOLENCE PREVENTION ACT — State vs. Carter

This act would specifically include the offenses of refusal to relinquish or to damage or obstruct a telephone section 11-35-14; Crank or obscene telephone calls section 11-35-17; Burglary and Unlawful entry section 11-8-1 et.seq.; and Arson section 11-4-2 et seq., to the list of named offenses in the "Rhode Island Domestic Violence Act." The purpose of this legislation is to expand the list of enumerated offenses contained in R.I. Gen. Law 12 –29-2 that would qualify for felony enhancement in the wake of State vs. Carter 827 A. 636 (2003).

AN ACT RELATING TO DOMESTIC VIOLENCE PREVENTION ACT — State vs. Martini

The purpose of this legislation is to add the crime of petty misdemeanor to the list of enumerated offenses contained in R.I. Gen. Law 12-29-2 that would qualify for felony enhancement in the wake of State vs. Martini 860 A.2d 689 (2004).

This act would provide that no portion of the mandatory minimum required jail sentence can be suspended, as specified under the Domestic Violence Prevention Act.
