AN ACT RELATING TO REGULATION OF SALES — Underage Procurement Misdemeanor
S- 2189 Felag
H- 7071 - Malik

This act would criminalize the furnishing of alcohol to a minor. Currently, RI law provides for criminal prosecution of an adult who purchases alcohol for a minor. However, the state has the burden of proving that the alcohol was purchased for the minor who has been connected to the alcohol. Typically, the nexus between the minor and adult via the purchase of the alcohol in question is nearly impossible to show. RI law provides no remedy for an adult who simply makes alcohol available to a minor. Criminally, any adult who can be shown to have procured or furnished alcohol to a minor will be guilty of a felony with a fine of up to $2,500 and up to a one-year jail sentence.
